4.1 Website Development

Our automation services aim to streamline your business processes. The scope and implementation details will be specified in a separate service agreement.

4.3 AI-Powered Bots

We develop and deploy AI-powered chatbots and virtual assistants. The functionality and integration of these bots will be detailed in a specific project outline.

4.4 Data Analytics

Our data analytics services provide insights based on your business data. The exact nature of these services will be defined in a separate agreement.

5. Intellectual Property Rights

The Services and their original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of MoreBytes and its licensors.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of MoreBytes.

6. User Obligations

As a user of our Services, you agree not to:

  • Use the Services in any way that violates any applicable laws or regulations
  • Impersonate or attempt to impersonate the Company, a Company employee, or another user
  • Transmit any viruses, malware, or other types of malicious code
  • Attempt to gain unauthorized access to any portion of the Services
  • Use the Services in any manner that could disable, overburden, damage, or impair the site

7. Payment Terms

Fees for our Services will be outlined in separate agreements specific to each project or service.

Unless otherwise agreed, invoices are due within 30 days of the invoice date. Late payments may incur additional fees.

8. Refund Policy

Please review our refund policy carefully:

8.1 General Policy

  • No refunds will be issued for services rendered or in-progress at the time of service termination or refund request.
  • Clients will continue to be charged for any service or product agreed to be paid back with installments, payment plans, or financing.
  • Services or products paid in full will not be refunded if any work has been performed, even if incomplete at the time of refund request or agreement termination.
  • Refunds require at least 30 days notice before any ongoing services or products are terminated.

8.2 Project Milestones and Deliverables

For projects with defined milestones:

  • Refunds may be considered for incomplete milestones if the project is terminated early.
  • Completed milestones and delivered work are non-refundable.
  • Partial refunds for incomplete work will be assessed on a case-by-case basis.

8.3 Custom Software Development

  • Custom software development services are generally non-refundable due to their bespoke nature.
  • In cases where the developed software does not meet the agreed-upon specifications, we will work to address the issues before considering any refunds.

8.4 Subscription-Based Services

  • For subscription-based services, refunds are not provided for partial months of service.
  • Cancellations made before the renewal date will prevent future charges, but will not result in a refund for the current period.
  • Annual subscriptions paid in advance may be eligible for a prorated refund, minus a cancellation fee, at our discretion.

8.5 Exceptions and Dispute Resolution

While we strive to adhere to this policy, we understand that exceptional circumstances may arise:

  • Refund requests due to extraordinary circumstances will be reviewed on a case-by-case basis.
  • In the event of a dispute, we encourage clients to first attempt to resolve the issue directly with our customer service team.
  • If a resolution cannot be reached, mediation or arbitration may be suggested as alternatives to litigation.

9. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

10. Limitation of Liability

In no event shall MoreBytes, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

11. Disclaimer

Your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Services are provided without warranties of any kind, whether express or implied.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of South Carolina, United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on this page.
